What are the limits to the extradition procedure?
There are several events that prevent an extradition procedure from being carried out:
First, there is a limit which relates to the author of the request for extradition from abroad. The requesting State must necessarily be a State officially recognized by France;
Then, there is a limit which depends on the date of the foreigner’s extradition request. Prescription applies to extradition. In other words, if the offense can no longer be brought before the judge in the requested State at the time of the extradition request, then it cannot give rise to extradition proceedings.
Because federal law regulates extradition between states, there are no states that do not have extradition. As of 2010, Florida, Alaska, and Hawaii do not extradite for misdemeanor convictions committed in another U.S. state.
